1. Right of withdrawal and refund.
1.1. A consumer - a natural person who is not related to economic or professional activity, in accordance with Clause 19 of Regulation No. 255 of the Cabinet of Ministers of the Republic of Latvia "Regulations on Distance Contracts" regarding distance contracts, can exercise the right of withdrawal and return the purchased product within 14 calendar days from , when he has obtained possession of the goods, without mentioning the reason for its return.
1.2. To exercise the right of withdrawal, you must inform BalticGuru.eu electronically by filling out the withdrawal form (in the Returns section) or in writing to the email address info@balticguru.eu and within seven days of sending the withdrawal form or application (e-mail), you are obliged to return the product to the seller .
1.3. Sending the refusal form or application within the specified period releases the consumer from any contractual obligations in connection with the respective distance contract.
1.4. After returning the goods, the seller evaluates the condition of the returned goods and prepares a document on the return of funds and sends a reply in electronic form.
1.5. If the consumer approves, the seller is obliged to refund the amount of money paid for the product to the consumer.
1.6. The right of withdrawal is not applicable if:
the product is perishable or soon to expire;
the consumer has opened the package for a product that cannot be returned due to health and hygiene reasons (e.g. epilator, electric shaver, etc.);
due to its characteristics, the product is irreversibly mixed with other parts of this product after delivery (for example, two acrylic paints in the package are mixed and separated);
the consumer has opened the packaging of audio or video recordings or computer programs (also applies to handheld computer, navigation device, etc. software);
2. Prices
2.1. BalticGuru.eu product prices are indicated in €, including VAT 21%. The offered prices are valid at the time of placing the order. By confirming the order, the buyer agrees to the current price of the product.
2.2. The seller reserves the right to unilaterally change the prices of goods at any time without notice. Goods and services are sold at prices valid at the time of placing the order for goods and services and published in the online store.
3. Assortment of goods
3.1. The buyer can purchase goods placed in the BalticGuru.eu online store. The goods can be bought as long as they are placed on the BalticGuru.eu website and available in the supplier's warehouse.
3.2. In the event that the buyer has placed an order, but it is no longer available to the supplier, but has remained for sale due to technical reasons, BalticGuru.eu informs the buyer about the situation by phone or in writing and, with the buyer's consent, offers an analogue product. BalticGuru.eu does not cover possible losses that may occur if the Buyer has placed an order for a product that is no longer available.
3.3. The seller has the right to unilaterally change the assortment of goods and change product descriptions at any time without warning. Product descriptions use information and images provided by manufacturers.
4. Receiving the goods
4.1. The product is delivered according to the delivery price specified in the order
4.2. Before receiving the goods, the Buyer must present an identity document - passport or ID card. The goods are issued only to the Buyer who has placed the specific order. If the Buyer refuses to present an identity document - passport or ID card - during delivery, the seller has the right not to deliver the product.
4.3. The buyer's duty, upon receiving the product before signing the delivery note, to visually assess the condition of the product in the presence of the seller/courier, whether there are any visual defects of the packaging or the product. The technical damage found after receiving the product did not cover the product warranty.
4.4. The delivery of the goods to the Buyer takes place in accordance with the delivery note, which is signed by the Buyer. The order is considered fulfilled upon receipt of the goods and signing of the mentioned documents.
5. Use of goods
5.1. The buyer is obliged to carefully familiarize himself with the instructions for use of the product before using the product. Use the product only in accordance with the manufacturer's instructions, according to the characteristics of the product and the intended purposes of use.
5.2. Claims regarding the product's compliance with the terms of the contract are dealt with in accordance with the provisions of the Law on the Protection of Consumer Rights.
5.3. BalticGuru.eu's liability does not apply to defects that have occurred as a result of incorrect use, transportation and/or storage of the product, as well as to normal wear and tear of the product during its operation.
6. Obligations and terms of the parties
6.1. The buyer (natural person) has the right to withdraw from the distance contract for the purchase of goods in accordance with regulatory enactments within 14 days from the delivery of the goods. In case of exercise of the right of refusal, the buyer is obliged to return the product to the seller in the same appearance/packaging as received. The buyer bears all costs associated with returning the goods.
6.2. A legal person is not considered a Consumer in the sense of the Law and on the Legal
6.3. The buyer agrees to the processing of his personal data in order to be able to process and fulfill the order, including by transferring it to third parties, ensuring delivery, processing payment, etc.
6.4. The website of the online store uses cookies. By using this website, the customer agrees to the use of cookies for performance/analytical purposes.
6.5. The buyer assumes all risks and responsibility for the purchases of the Internet store BalticGuru.eu, including the receipt (acceptance) of the goods. Upon delivery of the goods to the Buyer, the risk of loss or damage of the goods passes to the Buyer at the moment when the Buyer or his representative has obtained possession of the goods, except for the cases specified in the regulatory acts.
6.6. Seller shall not be liable for delays in non-fulfillment of orders caused by circumstances beyond Seller's reasonable control and which could not have been reasonably foreseen, including but not limited to strikes, government orders, acts of war or national emergency, environmental or climatic anomalies, disruptions in the Internet connection, as well as the failure of communication equipment, computer equipment and software.
6.7. By visiting the BalticGuru.eu online store, registering and/or placing orders in it, the buyer agrees to these Terms.
6.8. The Seller does not assume any risks or responsibility if the Buyer is not familiar with or partially familiar with the Terms of Use and the Privacy Policy.
